Terms of Service

1. Scope

These terms apply to the use of the InvestPhin app and licences for it, provided by PhinLabs Markus Egolf (sole proprietorship), Glärnischstrasse 52b, 8712 Stäfa, Switzerland ("we"). By installing the app or buying a licence you accept these terms.

2. What InvestPhin is

InvestPhin is a macOS app for recording and analysing your own portfolio, account and retirement data: import of broker and bank exports, dividends and calendar, net worth, portfolio check and further analyses; optionally the AI assistant Phin AI.

InvestPhin is a tool, not a data service. Your fee pays for development, updates, the licence server, Phin AI and support — not for price or market data. The features per plan follow the description on investphin.com at the time of purchase.

3. Prices and data sources

The app fetches prices, exchange rates and company information directly from your device from third parties. Without your consent it uses only a few services (e.g. OpenFIGI, Frankfurter/ECB) and services for which you enter your own API key.

You switch on further publicly accessible sources yourself in the settings. Many of these providers allow private use only; you are responsible for complying with their terms. Your own API keys are subject to the respective provider's terms.

We give no warranty that third-party data is available, current, correct or complete.

4. No investment advice

InvestPhin and Phin AI provide no investment advice, no buy or sell recommendations and no asset management. All analyses describe your own figures. You make every investment decision yourself and at your own risk.

5. Plans and prices

Free: no account and no licence, 1 portfolio, up to 15 holdings, no Phin AI, help via guide and FAQ.

Standard: CHF 5 per month or CHF 50 per year — unlimited holdings, up to 5 portfolios, Phin AI with 25 questions per month, 2 devices, email support.

Pro: CHF 10 per month or CHF 100 per year — as Standard, but Phin AI with 500 questions per month, 5 devices and priority support.

Prices are in Swiss francs. We are currently not registered for VAT. Payment is made in advance via the payment provider named at purchase.

6. Term and cancellation

A subscription runs for the chosen period (month or year) and renews automatically for the same period unless you cancel before. You can cancel at any time effective at the end of the current period, by email to [email protected] or via the payment provider.

When your subscription ends, InvestPhin switches to the free scope. Your data remains complete; only adding beyond the free limits is blocked.

We announce price changes at least 30 days in advance by email. They apply from the next period; you may cancel until then.

7. Licence and devices

The licence is personal and not transferable. Standard allows use on 2 devices, Pro on 5. You may not pass the licence key on to third parties. To check it, the app talks to our licence server (details in the privacy policy).

8. Phin AI

Phin AI is optional and asks for your consent before first use. In addition to the monthly quota, an hourly limit and a monthly cost cap apply to prevent abuse. Phin's import help does not count towards the monthly quota.

Answers are generated by an AI model and may be wrong or incomplete. Check important information yourself. If there are signs of an acute crisis, Phin replies only with contacts of official support services.

9. Updates and availability

During the term you receive updates at no extra cost. We operate the licence server and Phin AI with care but cannot guarantee uninterrupted availability. Analyses of your stored data also work offline.

10. Your data

The app stores your portfolio, account and retirement data on your device; we have no access to it and no copy. You are responsible for backups; the app creates backups on your device automatically.

11. Right of withdrawal (consumers in Germany and Austria)

Consumers resident in Germany or Austria have a statutory right of withdrawal of 14 days from conclusion of the contract; details on investphin.com/widerruf. If you expressly agree at purchase that we start providing the service before the withdrawal period expires (licence activation) and confirm that you thereby lose your right of withdrawal, it expires early (§ 356(5) BGB / § 18(1)(11) FAGG).

12. Liability

InvestPhin is provided as is. We are not liable for investment losses or errors in third-party data.

Our liability is limited to the amount you paid for InvestPhin in the last 12 months. This limitation does not apply to intent, gross negligence, breach of essential contractual obligations or injury to life, body or health.

13. Protective mechanisms

The app contains protective functions such as the licence check, Phin AI quotas and crisis protection. You undertake not to circumvent them. If you do, we may block the licence.

14. Changes to these terms

We may adapt these terms, e.g. for new features or changed laws. We inform licence customers of material changes at least 30 days in advance by email; if you do not object before they take effect, they are deemed accepted. We point this out in the notice.

15. Governing law and jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Zurich, Switzerland. For consumers in the EU, the mandatory provisions and jurisdiction of their country of residence also apply. In case of doubt, the German version prevails.
